All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of assisting the Customer appropriately to meet the Customer’s needs concerning the provision of the Company’s stated services, in accordance with and subject to the prevailing laws of Estonia. Any use of the above terminology or other words in singular, plural, capitalization, or he/she or they, are interchangeable and therefore refer to the same.

Kenzly is an event marketplace designed to inspire creativity and enable online earning opportunities globally. By creating an account and accepting these terms, you become a valued member of our community. As an Organizer, you gain access to an event market account, allowing you to buy and sell items akin to those available on the Kenzly website and engage in related transactions.

Membership

To buy and sell tickets and products, you must be 18 years or older. If you are under 18, you must have a parent or guardian make purchases on your behalf or use the account of a parent or legal guardian who is at least 18 years old, with their permission. The adult will be accountable for all your activities.

Your Responsibilities

You agree to provide us with accurate, truthful, and complete information. If you create an event organizer account, you commit to keeping your account details current, including your email address. Your membership is non-transferable, meaning you cannot sell your account. You are accountable for all activities related to your username and password, so it’s crucial to safeguard your password and refrain from sharing your login credentials. If you suspect any unauthorized use of your password or notice a security breach, please inform us immediately. You must not use a virtual private network (VPN) or any other methods to circumvent these terms and conditions or engage in any fraudulent or unlawful activities.

  10. Reverse engineering, reverse compiling, or deriving underlying source code of Kenzly Websites services or technologies.
  11. Overloading server resources with intensive CGI/PHP scripts, causing noticeable disruptions or breakdowns.
  12. Distribution of illegal copyrighted material under the Digital Millennium Copyright Act (DMCA).
  13. Engaging in denial-of-service attacks (DoS/DDoS attacks).
  14. Registration using temporary, disposable, or fake email addresses is prohibited.
  15. Use of botnets and illegal IRC servers.
  16. Torrent trackers, warez sharing, nulled scripts.
  17. Network and port scanning or brute-forcing.

Community

This Agreement becomes effective from the date stated herein.

Purchasing Tickets for Events, Meetings, and Activities

Every user is required to carefully read the event details, including the event date, before proceeding with the purchase. Additionally, users must identify the event organizer or entity before confirming the purchase. It is essential to note that each event has a specific reservation cancellation policy, which is outlined on the event page. Some events allow refunds, while others do not. For detailed information, please refer to our return policy page on the website.

Customer and Event Organizers’ Information

Please be aware that event organizers, whether individuals or companies, have access to the list of customers who have purchased tickets. This information is used to facilitate event attendance and includes participants’ names, number of tickets, email addresses, and phone numbers.

Email addresses and phone numbers may be used to communicate important event-related information to participants or to inform them about upcoming events organized by the same entity. In case of misuse, such as unsolicited advertisements for other events or offers via phone or email (spam), please contact us directly. Misuse of this information could lead to consequences for the event organizer’s account. To report or stop such communication entirely, please notify us promptly.

Event Feedback and Rating

Providing feedback on events is crucial as it reflects customer satisfaction levels and highlights both positive and negative aspects attendees experience during the event. We strongly encourage both organizers and attendees to share their thoughts by leaving comments and ratings. This valuable input plays a significant role in enhancing the services offered on our platform and elevating the organizers’ performance standards.

Assumption of Risks

By attending live events, you acknowledge and accept the inherent risks associated with such activities.

Certain events may involve inherent risks, and by choosing to participate in these events, you willingly assume those risks. These risks might include the potential for illness, physical injury, disability, or even loss of life, and you consciously and voluntarily accept these risks when opting to attend such events.

While most events on our platform are not organized by Kenzly, if you choose to participate in one hosted by us, you accept all associated risks.

When you attend an event we host, you waive any claims and legal actions against Kenzly Released Parties, event producers, presenters, and their insurers. This waiver includes liability claims for personal injury, property damage, or wrongful death related to your attendance at the event.

Ticket Transfers

In some cases, ticket transfers are possible.

If you want to transfer tickets for an event you’ve bought on our platform, please reach out to the event’s Organizer to facilitate the transfer. If you encounter difficulties contacting the Organizer or if they are unable to assist with the transfer, kindly get in touch with us. We’ll do our best to help facilitate the ticket transfer for you.

Payment Options

To make attending events and purchasing services or products convenient, we offer a variety of payment methods suitable for individuals, companies, and diverse countries.

PayPal Payment
Our primary payment method is PayPal, a secure and swift option available for users in most countries globally. Simply select PayPal during the payment process to complete your transaction seamlessly.

Bank Transfers

  • European Union Countries
    Customers in European Union countries can make direct bank transfers in Euros. The transfer is confirmed by attaching a copy of the transaction and verifying the deposit in the account.
  • All Countries Worldwide
    For customers worldwide, we accept bank transfers in either dollars or euros through our Wise Company account. Euros can also be transferred directly to our bank account.
  • Other Payment Methods
    We might offer alternative payment methods for specific countries, including options like Western Union, KNET, or Vodafone Cash. For inquiries about additional methods, please reach out to us.

Termination

We reserve the right to restrict your access to our Services.

We have the authority to suspend or terminate your access to the Services under the following circumstances:

  • You violate these Terms or any other agreement between you and us, or if you fail to make timely payments;
  • You misuse or abuse the Services, or use them in a manner not intended or allowed by us;
  • Your conduct, either on or off the Kenzly Properties, poses a threat to the safety of our community or the integrity of the Kenzly Properties, or interferes with the experience of our community or the Kenzly Properties; or
  • Allowing you access to the Services would violate any applicable local, state, provincial, national, or other laws, rules, and regulations, or court order, or would expose us to legal liability.

We reserve the right to discontinue offering the Services, or any specific portion of the Services, or modify or replace any aspect of the Services, at our discretion and at any time. We will make reasonable efforts to notify you if we terminate your access to the Services, unless we believe that failing to do so would significantly harm you. You agree that we will not be held liable to you or any third party for terminating your right to use or access the Services.

Collaborative Events

Collaborative events are events organized in partnership between Kenzly and event organizers, be they individuals or companies. Details about these events are explicitly stated in the event descriptions. These collaborative events can occur both online and offline, spanning various countries worldwide.

During participation in a Kenzly collaborative event, the specific role of Kenzly – whether as a host, managing or in another capacity – will be clearly outlined and announced.

Organizers Guidelines for Creating Events, Meetings, and Activities

As an event organizer on our platform, whether you are an individual or a company, you have the opportunity to create events, both free and paid. However, to ensure a smooth experience for our users, we have established some key conditions that organizers must adhere to:

  • Clear Event Details: Provide clear information about the event, including venue, time, and speaker details. Additionally, you can link an external website for comprehensive event information.
  • Online Events: For online events, specify the event’s duration, date, and language clearly for users.
  • Appropriate Classifications: Choose relevant event classifications to enhance accessibility. The selected classifications must align with the event’s nature.
  • Hashtags Usage: Use hashtags, limited to five words, preferably common and relevant to the event theme on our site.
  • Free Events: Free events are allowed; however, organizers should not request financial commitments from attendees later.
  • Adherence to Event Details: Commit to the event dates and adhere to the announced prices and details as listed on the site.
  • Participant Feedback: Encourage participants to leave comments and evaluations after the event. This feedback not only ensures service quality but also informs future attendees about the event’s value.
  • Promotion and Usage: We may promote events on our website through social media and advertisements without explicit permission from the organizer. If you prefer otherwise, please inform us after the event is published.
  • Multiple Ticket Types: Organizers can create multiple ticket types and duplicate events on the calendar, especially useful for courses, teaching sessions, and webinars, facilitating user convenience in selecting suitable dates.
  • Joint Events: Collaborative events with Kenzly require prior approval, clearly stated in the event details. Use of the company name, its representatives, or site logos without permission is prohibited.
  • Organizer Profile: Utilize the organizer’s profile page to showcase all organized events. This feature assists customers in identifying previous events and helps establish a robust profile on our platform.
  • Promotion Guidelines: Organizers can promote events on their social media and internet advertisements, excluding official sponsorship from Kenzly unless prearranged and agreed upon in advance.

Refund Policy

Organizers are required to set a clear refund policy for each event during the event creation process. This policy can be specified as non-refundable or refundable, with a defined number of days within which participants can request a refund before the event.

Participants also have the option to request a refund within one day after the event concludes, particularly if they are dissatisfied. We will consider these requests if they align with logical and agreeable reasons, supported by the majority of attendees.

Customer Information Policy

Please be aware that event organizers, whether individuals or companies have access to the list of customers who have purchased tickets for their events. This information is utilized to facilitate event attendance and includes participant names, ticket quantities, email addresses, and phone numbers.

Email addresses and phone numbers may be utilized to communicate essential event-related information or inform participants about upcoming events organized by the same entity. Any misuse, such as sending unsolicited advertisements for unrelated events or making unsolicited phone or email solicitations (spam), can result in consequences for the event organizer’s account.

These consequences may include temporary account suspension, permanent account deletion, or exposure to legal liability, in accordance with our user data protection policy.

Risk Management

Certain events and activities may carry inherent risks that could potentially expose participants to illness, injury, or even fatal consequences. We have clearly outlined in our customer policy, under the risks section, that we do not assume responsibility for these risks, and participants engage at their own discretion.

We strongly encourage all event organizers to implement adequate safety measures and precautions for participants. For activities involving a high level of risk, organizers can consider involving insurance companies to ensure compensation for participants. Additionally, support from specialized companies in insurance and safety can be sought.

Our paramount concern is the safety and well-being of our customers. If we assess that an event poses a high level of risk, either financially or physically, and adequate safeguards are not provided, we reserve the right to decline the publication of such events on our website to prioritize participant safety.

Ticket Pricing

On our website, you have the flexibility to list events or activities as either free or paid, with no concealed conditions. All you need to do is clearly state whether the event is free or paid. The specified price must be final and not subject to changes after the initial booking process is completed.

Tax Fees

If tax fees are applicable in your country, you can include the tax value in the ticket price, for example, 10%. During the payment process, these taxes will be automatically calculated for buyers. If you are tax-exempt, please enter ‘0’ in the tax box.

Please be aware that all organizers and service providers on our site are responsible for paying taxes in their respective countries. We do not assume any responsibility for your tax obligations, and we do not pay taxes on your behalf. If required, you can submit your income report on our site to the relevant authorities.

Payment Fees

Please be mindful that certain payment platforms, like PayPal, deduct a portion of the service fee. It’s essential to set your pricing accurately and calculate your profits carefully to avoid unexpected losses due to these deductions.

Payout Policy

Your account becomes eligible to receive funds three days after the event concludes. This period allows one day for customers to request refunds. Afterward, two days are allocated for account processing. On the fourth day, the funds are transferred to your selected account, whether it’s PayPal, bank transfer, or another method. Please note that holidays are not included in the three-day period.

It’s important to be aware that the money transfer process can occur on the same day or take anywhere from 3 to 7 working days, especially for bank transfers, depending on banking regulations in your country.

Payout Methods

Each organizer can add suitable payment methods through the control panel and can choose multiple methods if desired. Accrued profits can be checked by selecting the wallet option from the control panel, displaying all profits and previous account transactions.

Please note that all payment processes are conducted both manually and automatically. The account undergoes a review, and recovery requests, if any, are deducted, followed by payment fees for intermediary companies like PayPal, if applicable, and Kenzly fees.

Here’s an example for clarification:
Let’s say you sold 100 tickets for an event, each priced at $10. Total sales amount to $1000.
The tickets were purchased via PayPal with a fee of 80 cents per ticket, totaling $80 in PayPal fees.
The net profit stands at $920.
When requesting profits of $1000, the aforementioned fees, along with Kenzly service fees based on the subscription plan, will be deducted.

To request funds, simply access the wallet, choose the option to withdraw, and specify the amount you wish to withdraw. You can request the full or a partial amount. Once the request is received, we complete the payment process to your preferred account, typically within three days after the last event.

External Ticket Link

When setting up your tickets, you have the option to choose between:
Internal Link: Enables booking tickets directly on our website.
External Link: Clicking on the booking ticket button will redirect users to the link you have specified.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
